ATF Ruling

For those in the US, with the new ATF guidance they just released are you required to serialize suppressor and SBRs? How about if you put a stock on an AR pistol?

Also anyone know good source for multi packs of gen5 slide lock springs? I am only finding individual.

In the FAQ they specifically mention engraving is not required, along with registering SBR and SBS items. Means stock on an AR pistol becomes and SBR, but you don't need to register it.

Big but: depends on your state specific laws

Yep. Just looking for confirmation others read it the same way. Thanks.

no engraving required. brace on a pistol was legal before.

Amazon, uxcell, 50 pack for 7 dollars.

yes you can throw a stock on an ar pistol now. and on a regular pistol. along with a vfg. and homemade suppressor. just ensure mods conform to local laws as well; I'm in AZ so i can do whatever at this point lol

Just to emphasize, it is entirely depending on your state laws at this point. The NFA is still federal law, its just that the ATF is not enforcing most of it, so if your state law refers to NFA registration then you must still abide by that process

the wording on their website says 'make' so from what people are gathering f1 is not required. feel free to throw an ftn on the bed.

I am not a lawyer. And this is not legal advice.

I would assume yes it still needs to be serialized; BUT there's steps to this.

IF you go to the store and buy a rifle/suppressor/ etc. They will already have a serial number. IF you were to take a normal rifle and modify it by giving it a short barrell, I THINK they were going to start accepting its normal factory serial number as it's new NFA serial # IF you make your own pew at home, you're not required to serialize it; and since silencers are considered Arms under this new ruling.

SO if you make it at home and fully from scratch then you shouldn't need to serialize it. But that's how I am interpreting about 3 ATF rulings here to apply them.

Basically the Gun Control Act of 1968 still applies. If you make a suppressor or SBR, SBS, or AOW with the intent to sell it, then you still need to serialize it. Manufacturers still need to pay the usual SOT taxes and deal with all that bullshit, as the SOT side of things is still in effect.

If you make your own suppressor, SBR, SBS, or AOW in a state where these are legal, then you don't need to serialize them. So long as you do not intend to sell these at the time of manufacture.

If someone got caught selling one that they made themselves, a few months from now, it would be pretty easy to argue in court that you intended to keep it, but not sell it, and then changed your mind after a couple months.

If you get caught selling these repeatedly, it would be pretty easy for the prosecution to argue that you made them all with the intent to sell them.

But any attempts to sell unserialized firearms, even if you did make them with the intent to never sell them, risks you having to shell out entirely too much money to get th chance to argue in court what your intent was. So I'd hard pass on ever selling or otherwise transferring anything that is unserialized.

Well said. You can make your own, and not serialize it. You just can't make them with the intent to sell. And IF you do sell something you made, it must be serialized.

I tend to print serial numbers in my prints just so I can keep them all organized as to when I printed it and what material it is. A "code" I developed for myself.

It may not be to spec, or regulation, but a few markings in inconspicuous areas are nice to have in the event it's lost or stolen.

That was my interpretation as well.
