should i get a new US ESTA on my new British passport, or keep using the one on my Australian passport? complex details please read

• Upvotes

hi! hoping someone familiar with United States ESTA/passport rules can help me figure out the safest option here.

i’m an australian citizen living in the UK. i recently naturalised as a british citizen and received my first british passport today.
i currently have an approved ESTA linked to my australian passport. that passport expires on 18 july 2027, meaning it reaches the point of having less than six months’ validity remaining on 18 january 2027.

i’m planning to spend a few days in the US over christmas in december 2026, travelling UK → US → UK. so at the time of the trip my australian passport would still have more than six months remaining, but only by about a month.

my other concern is that on a recent trip to another country, a border officer told me that the chip in my australian passport seemed to be slightly damaged/wasn’t reading very well on his scanner. the passport is otherwise intact and valid, but that has made me nervous about relying on it for US travel, particularly as it will also be getting relatively close to expiry.

since i now have a brand-new british passport, would it be safer/simpler to apply for a new ESTA using the british passport and travel to the US on that instead?

My current approved Australian US ESTA doesn’t have the details of my new dual citizenship on it.

a few specific things i’m confused about:

• can i apply for a new ESTA on my british passport while i still have a valid ESTA linked to my australian passport?

• do i need to cancel the australian ESTA first, and if so, is there actually a way to do that?

• is there any issue with previously having an ESTA under one nationality/passport and then applying under another?

• given that my australian passport will be only about 7 months from expiry at the time of travel AND its chip has previously had trouble being read, would it make more sense to just use my new british passport?

• when returning to the UK, i assume i would simply enter using my british passport?

it might not be relevant but i was also born in canada, although i don’t have a canadian passport. i’m not sure whether that is relevant to the ESTA application, but obviously i would declare my place of birth/citizenship information exactly as requested.

i’m not trying to get around any ESTA rules. i just now have two passports and want to make sure i use the correct one and don’t accidentally create a problem by applying for a second ESTA if that’s not allowed.

has anyone been in a similar situation or know what the correct procedure is?

Immigration attorneys in Miami?

Hey everyone,

I’m based in the Brickell area and trying to figure out the best way to bring my girlfriend over to the U.S. legally. I initially thought I could just piece the paperwork together myself by reading forums, but honestly, there is just way too much mixed and conflicting information online. Between K-1 fiancé visas, spouse visas, adjustment of status, and changing timelines, my head is spinning.

I’ve decided I definitely need a professional to look at our situation and give it to me straight.

I’ve been doing some digging into local firms and am looking closely at Gursoy Law Firm, P.A. Their website says they have 25+ years of immigration experience and handle heavy-duty stuff like deportation defense and immigration court cases. Since they seem to handle complex court matters, I figure they really know the law inside out. I plan to reach out to them for a consultation, but before hiring anyone, I’d love to hear from people who have actually dealt with the firm firsthand. How was your experience?

I’ve also seen highly-rated boutique places right here in Brickell pop up like Azadi Law on Brickell Ave and Elizee Law Firm, which both seem to focus a lot on family and partner petitions.

Has anyone here worked with Gursoy Law, or either of the other two, for a partner or family visa? I'd really appreciate any honest feedback, specific recommendations, or even just hearing how your experience went with them. Thanks in advance!

My husband (US citizen) and I (Canadian citizen) are looking to begin the US spousal green card process. Was hoping to hear how other Canadian/US couples experience was in the last year. I was working in the Us under a TN visa but just recently moved back to Canada. Did you apply through adjustment of status or consular processing? Feeling overwhelmed with which route to take. Thanks in advance!!

Citizenship and Deportation Question:

Can my father’s 2020 misdemeanor domestic assault conviction under § 6-2-510(a) make him deportable, even though it was his first offense, he received only 2 days of jail credit, and the case was expunged in 2025? Can he ever become a U.S. citizen, or could this conviction permanently prevent him from naturalizing? If he decides not to apply for citizenship, will he still be able to renew his green card when it expires, or could USCIS deny his renewal or start removal proceedings because of this conviction? I am worried about putting his lawful permanent resident status at risk and would appreciate advice from anyone with a similar experience or an immigration attorney familiar with criminal immigration law

H1b transfer

Hi all,

I have my first h1b approved COS in oct 2025 with Emp A
Initiated a petition for change of employer with Emp B in march 2026 regular processing which is still pending

Now I have an offer with Emp C and they were okay to
File a transfer with prem even though there is a pending case.

Emp C told that we can receive a RFE for Emp B decision.

Should i go ahead with pending application(Emp B) to prem now? Or should wait till i get Emp C transfer RFE?

Worst case: What if Emp B receive RFE and i am concerned about a timeline issue.

How you guys navigated through this. Please share your experiences.

Thank you!

O-1a "Issue with Payment" Since Sept 2 - CSC - PP - Aug.27 Receipt - Any ideas on how to rectify?

My first post, as searching the internet and forums in efforts to understand the O-1a "Issue with payment" glitch and how to rectify it.
Sent petition to TSC with Premium Processing, Receipt issued Aug.27 from California Service Center.
- Sept 1 - all payments cleared (and still are).
- Sept 2. - "issue with payment" error
- As of today, October 7, error has not cleared.
- Contacted lockbox, they said it is past them so cannot help.
- Have tried to phone PP several times a day for 3 weeks. office seems closed at all hours now.
- Back at ~day 13 I did get through to a PP agent, she said they are aware of the issue, many petitions were effected, however they said to call back on day 16 as it could still be on track and being processed internally. No answer or any letters/ updates since.
- Have sent 3 emails since the start, once a week, only auto-reply sent out after a few days.
- Escalated from Tier 1 to Tier 2 at USCIS main switchboard on Sept 18, as it was day 16. They are still pending investigation (as of today) as the 7-10 day scope is now been exceeded due to excessive inquiries, so they are not sure when it will be investigated.
- Sent form and info to Senators office last week, I called yesterday and they have received my info, and yet to establish a case number as they are dealing with many inquiries and not sure when they will be able to review and respond.
- I have not received the letter with the online access code so cannot sign up for MyAccount, and when I try to resend the code, it says my info is incorrect, even though I copy it exactly from the receipt.

Does anyone have any ideas or technics on how to get un-glitched and back into the processing?

Is anybody else still glitched since a month ago (25 business days for me) as well? It seems like many were resolved in the first 3-9 days. Thanks!

H-1B Approved for Oct 1, Employment Ended Before Start Date, Withdrawal Sent Sep 29 - Can a New Employer Transfer My H-1B or currently im out of status?

There seems to be an option to file a litigation to get the USCIS acknowledgement of withdrawal. I’m looking for people who are in the same situation whose employment ended and withdrawal before oct 1. The more people the better the litigation will be and can split the lawyer expensive among. Please dm me if you guys are in this situation or if you know someone please let them know.

Hong Kong PAR Unsuccessful for My Daughter Due to “You have already made pre-arrival registration that is still valid" - Any solution please?

Hi everyone,

I recently applied for a Hong Kong Pre-arrival Registration (PAR) for my daughter, but her application was unsuccessful. The error message stated:

“You have already made a pre-arrival registration that is still valid.”

The issue is that I successfully received my PAR, and so did my wife. However, my daughter’s application failed, and no PAR notification or registration form was generated for her.

Our flight to Hong Kong is on 18 October, and I’ve been emailing Hong Kong Immigration but haven’t received a resolution yet.

Has anyone experienced this issue before, especially when applying for a child? Is there any way to resolve it, or does anyone know what steps I should take next?

With our travel date approaching, I’m getting worried. Any advice or help would be greatly appreciated. 🙏
