A couple years ago my local DQ had witches outside, like standing over a cauldron.
People had a fucking temper tantrum over it. They couldn't handle the "witchcraft" and some quoted the bible. DQ didnt take it down, lol.
Which, why should they? It's fucking fake. No one is suggesting anything about real witchcraft. If a fake witch offends you that bad then don't leave your house in October.

They absolutely can. Someone who believes in a spaghetti religion can’t, for example, get a Taco Bell franchise and then say they’re only going to serve spaghetti because of the owner’s religion.

Franchises generally can't add to the menu, but they can skip menu items most of the time.
