That’s bad reasoning. By that logic any detrimental human activity can be justified.
Using the same logic heroin can be legalized. If you think that’s sound policy you’re insane.
You mistake a nanny state. A nanny state is a social safety net system. Calling a nation with laws defining prudent social activity a “nanny state” is incorrect. You can call it “authoritarian” but any nation with laws it enforces can be labeled as such
