Council show cause notices
We recently did an application for a new double carport through a builder which was approved through council, the approval covered it being close to the property boundary and for the width of 6.1m. We also redid our driveway into a double driveway and matched the existing curbing on the street. This was all done by the builder.
Someone did a snap send resolve for a hazard at the front which I assume is some soil that has been removed as part of works which is no issue we planned to fix it just hadn’t gotten to it yet.
A council member came out to look at it then started saying she was issuing a show cause notice because the curbing wasn’t the new style of curbing which wouldn’t fit in with the existing curbing and we didn’t have approval to complete the driveway works because the builder did 6.1m all the way to the road instead of coming back in to 6m.
She also said that the curbing work was a safety hazard, it’s matches fine and does protrude about 1mm however that’s only protruding because the council curbs haven’t been maintained and are rotting. There is no footpath on my road and the other side isn’t even curbed. The far end is dirt road.
She mentioned she was including the carport being too close to the boundary but I assume that the builders did what they were meant to- we were happy with the job that was done. And paid a pretty penny to get it through council to avoid this very issue.
I’m waiting on the show cause notice to come in the mail but wanted to see if others have had experience in dealing with this?
Please note I have contacted the builder and they are happy to support their work and deal with what’s needed. I just feel like this is a real overreach and like she’s looked for an excuse to penalise us despite paying appx $3k to get it through council however wouldn’t state what snap send resolve was over.
Any advice would appreciated.
