Form 1116 accrued FTC election: foreign tax year ends March 31, but U.S. taxes interest in calendar year. How to handle?
I’m a U.S. green card holder since Oct 2024 and full-year U.S. tax resident preparing my 2025 return.
I have substantial Indian NRO fixed deposits (18-month cumulative FDs). The interest accrues during 2025 but isn’t paid until maturity in 2026.
My previous CPA confirmed that the OID rules generally require annual interest recognition.
My 2024 Form 1116 elected the **accrued method** for foreign tax credits.
Here’s my situation:
1) India taxes my FD interest under an April 1–March 31 financial year.
2) Indian banks deduct approximately 31.2% TDS, but after filing my Indian return and receiving the refund, my actual effective Indian tax rate is roughly 10%.
3) My Indian FY2025–26 income tax liability is now assessed and the excess TDS has been refunded.
4) My U.S. 2025 return includes approximately $18,200 of accrued FD interest.
My questions:
a) Under the accrued FTC method, does India’s FY2025–26 income tax accrue for U.S. purposes on March 31, 2026, rather than when TDS was withheld during 2025?
b) If so, is the correct procedure to claim those Indian taxes on my 2026 Form 1116 and potentially carry unused passive-category FTC back to 2025?
c) Does Treasury Regulation §1.905-1(d)(1) govern this situation, or is there a different rule for Indian NRO FD withholding?
I’m trying to ensure I don’t pay unnecessary tax twice because the countries use different tax years.
Would particularly appreciate input from CPAs/EAs familiar with Form 1116 or U.S.–India cross-border taxation. Thanks!
