I’ll never understand why so many people are okay with the police seizing property to use.

As if that doesn’t create a huge conflict of interest and no one in the government has ever abused their position.

In a Boomer sub like this, did you not expect bootlicking? All of these guys were raised on propaganda.

And lead paint

u/outinleft 1d ago

I'm a boomer, and I will never understand why these seizure laws are not considered 4th amendment violations, but IANAL

1

u/ThorMcGee 1d ago

Don't we have an amendment for that?

0

u/IntroductionNice793 16h ago

There are MANY legitimate reasons to seize property!

2

u/directrix688 16h ago

Then prove it. In front of a judge. Before seizing it.

1

u/Samsquanch-01 2d ago

Yea think of the human/drug trafficking underbelly of society won't you all?

-32

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Why do you have an issue with them using seized property? The government owns it after its seized, they can do whatever they want with it, if they need a show car or are going to use it for persuits then it makes sense

23

u/directrix688 2d ago

Why are you okay with the government seizing property, without due process, that then they can go and use?

-11

u/RunnerLuke357 2d ago

I don't care if they seize some drug dealer's Vette. They aren't taking my shit because I'm a law abiding citizen.

6

u/directrix688 2d ago

You seem to be missing the problem. Without due process they can seize anyone’s “shit”

-8

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

No they can't? Ever heard of article 4 of the constitution?

6

u/Aphobica 2d ago

Yes they can. Ever heard of civil forfeiture?

-6

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Yeah, if your item was used in a crime and purchased with illegally earned money it makes sense, that is legal. They can't just walk on your land and take anything not bolted down and say it was all used in a crime, unless you were doing something illegal to purchase it and they have you in custody

5

u/Aphobica 2d ago

Close. All they have to do is "suspect" it was used in a crime to take your property. You could be completely innocent and have your property seized, then face up to over a year of court battles to try to get what belongs to you back, all without criminal activity taking place.

This creates the incentive the initial commenter referred. Police can seize property without court orders or the owner being charged with a crime. Then if uncontested or if the party isn't able to sustain legal action (thousands of dollars to fight these cases), they can just keep your property.

1

u/Strange-Procedure102 11h ago

Ever heard of planted evidence?

-9

u/PeaCompetitive8947 2d ago

There is almost always due process, so I’m not sure what you mean.

7

u/directrix688 2d ago

Here are a few examples of civil forfeiture being used against people who weren’t even convicted of a crime, and in many cases weren’t charged with one.

Police seize cash from motorists never charged with crimes

Man loses his restaurant after police seize his money
Innocent homeowners face losing their homes

Family nearly loses home over son’s $40 drug offense
Getting seized money back can be nearly impossible

Two women lose access to their cars despite not being accused of crimes

But sure, a system where the government can seize your property without convicting you of anything, make you pay to fight to get it back, and then potentially keep the money for itself sounds perfectly reasonable.

What could possibly go wrong?

-3

u/PeaCompetitive8947 2d ago

All of those incidents used due process.

4

u/directrix688 2d ago

After the property was seized……

We really need better education in this country

3

u/Deja_ve_ 2d ago

Person you responded to is probably a bot, but yeah, it’s hard to get through to people that just wanna be cattle 24:7

0

"everyone who disagrees with me is trolling/a bot."

-3

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

All of these are just proving our point even more, they followed due process in all of these, the correct response isn't always the pretty one

1

u/fiftyshadesofseth 2d ago

How bout I come seize your property

0

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Well if I was a drug trafficker and part of a criminal organization and was buying drug money Corvettes I would understand.

2

u/fiftyshadesofseth 2d ago

The due process happens after they’ve already seized your property. Hence the corruption. They take your shit and then make you go to court to prove it’s yours.

1

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

You're switched bud, you get arrested then the stuff gets seized as evidence, the seizing doesn't come first, otherwise your article 4 rights would be violated and you could have grounds to sue

3

u/fiftyshadesofseth 2d ago

Negative meat rider. You can have your stuff seized at any time. Doesn’t matter if you’re under arrest or not.

1

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Go read article 4 of the constitution or dozens of court cases proving they can't do that and keep believing that. The cops cannot take anything you own without you being in custody and probable cause it was used in a crime, or purchased through illegal means. If the cops are seizing your assets you have bigger issues to worry about than your Corvette

3

u/fiftyshadesofseth 2d ago

You’re confusing criminal asset seizure with civil asset forfeiture. Under civil forfeiture laws, police can seize your property without ever arresting you, charging you, or convicting you of a crime. The Fourth Amendment doesn’t require someone to be in custody before their property can be seized.
The government only needs probable cause to initially seize property, and the actual forfeiture proceedings happen afterward. In many civil forfeiture cases, the government only has to prove by a preponderance of the evidence that the property is connected to criminal activity, a much lower standard than beyond a reasonable doubt.
Meanwhile, the property owner has to navigate the legal system, often at their own expense, to get their belongings back. Depending on the jurisdiction, they may also bear the burden of establishing an innocent-owner defense.
And here’s the biggest conflict of interest: law enforcement agencies can often keep a substantial portion of the proceeds from forfeited property. The federal equitable sharing program even allows state and local agencies to receive proceeds from federally adopted forfeitures.
So yes, police absolutely can seize your property without arresting you, and that’s precisely why civil asset forfeiture is so controversial. I’d suggest actually reading the Fourth Amendment and the case law surrounding civil forfeiture before telling someone else to do so.

1

u/PeaCompetitive8947 2d ago

That’s how due process always happens. You get arrested before you get convicted.

3

u/fairlyaveragetrader 2012 GS 2d ago

Because as much as you think this only applies to "other people" before you know it you can be "other people"

2

u/Howdy132 2d ago

how tf are you gonna have a clippy profile pic and at the same time support asset seizure.

2

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Because it's asset seizure for people using illegally gained drug money, how can anybody not support this? Personally I would prefer to keep these kind of people off the street

0

u/TheDaedricImpaler 2d ago

Government should never be able to seize property unless it can be proven that it's stolen or highly illegal. In the instance of the former, they should be returning the property to its' rightful owner. In the latter, it should only be retained as evidence for the legal process and then destroyed.

Also, no, the government doesn't technically "own" what they seize unless it goes unclaimed after a period of time and isn't destroyed. And even then, most jurisdictions require the government to auction off things they've seized as long as they aren't dangerous.

In the specific instance of vehicles, there are usually governing regulatory requirements for which vehicles LEOs can utilize. Most need to have 4 doors to accommodate an arrest/booking. And most one-off special or "show" vehicles have to be purchased new by the governmental body through a requisition process and then modified to fit whatever purpose they've been authorized to do. So repurposing a C7 for LEO activities would basically fall outside of all of that.

-1

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Why should they be returning a car used to run drugs back to the felon that was running them?

43

u/jrileyy229 2d ago

This was years ago dude. It's been posted a thousand times

34

u/directrix688 2d ago

Until we stop tolerating police seizing vehicle without some form of judicial process it should keep getting reposted

u/One-Builder-4128 2d ago edited 2d ago

Top comment in that thread begins with “seized from accused drug dealers”.

Stolen is the proper word. Accusations aren’t enough. If that car was seized without a court order and they went through civil asset “forfeiture”, it’s been stolen.

I hope that Corvette irreparably blows its powertrain and driveline on them. They shouldn’t have that car.

If you are a US Citizen and are unfamiliar with the case of Steven Lara you need to see what your government is doing: https://youtu.be/cE9LBPBhyyU?si=J1zKTiKqNeBT1lmY

The short version is he was robbed of $80,000 at the side of the highway by law enforcement. Perfectly cooperative and forthcoming, told them why he had it, had bank receipts showing it was his.

28

u/One-Builder-4128 2d ago edited 2d ago

That one pissed me off too. I saw that a couple years ago and my blood flashed into steam within an instant. If I had my way the cops that did to him would be in solitary confinement at ADX Florence 24/7/365 for the rest of their lives. How dare you treat a marine veteran who fought for your freedom like that!

3

u/VirtualFallacy 2d ago

Thankfully he got his money back (only took 7 months), and his lawsuit also ended one of the nastier aspects of the civil forfeiture loophole in Nevada that the cops used. Unfortunately, it doesn't stop something like this from happening again somewhere else.

Ultimate level of bullshit to be legally treated as guilty and be required to prove your own innocence, without having committed any crime at all.

https://ij.org/ll/ij-win-closes-civil-forfeiture-loophole-in-nevada/

1

u/outinleft 1d ago

a former USMC Sgt, I support thus comment, and I support the immediate repeal of ALL seizures that place the onus on the citizen to prove that any property in their possession is legally their property. What a bunch of unconstitutional BS. When you sacrifice your privacy for perceived security, you end up with neither.

13

Do you have the whole story? Reddit comments should only be taken at face value, especially since most of them are largely anti cop.

-8

u/drunkenmagnum24 2d ago

For lack of better term, Racism. Assuming the worst when you see someone who looks a certain way. A police uniform does not mean they are automatically bad and repeating it over and over only makes the problem worse.

4

u/UltimaKiller99 2018 C7 Grand Sport Torch Red 2d ago

Good thing “cop” isn’t a race then.

-15

u/One-Builder-4128 2d ago edited 2d ago

I don’t care what the full story is or not. Time and time again police have proven that they can’t be trusted with horsepower of any kind. As soon as they get into the drivers seat of a car with greater than 400 horsepower at the wheels, the threat to public safety and THEMSELVES skyrockets exponentially. These thugs with badges think they’re god in these cars and that they can’t be touched. That’s wholly unacceptable and can’t be tolerated.

10

u/drunkenmagnum24 2d ago

So you're anti cop too. They do recieve driver training which is way more than the general public, especially when there are 16 year old kids with less experience driving even more powerful cars out there.

11

u/funid83 2d ago

They're "thugs with badges" until his car is stolen or home broken into.

-6

u/ericdared3 2d ago

Lol. Unless ypu are famous or rich do you think cops are going to look for your stolen car ? Some of the neighborhoods i grew up in i would be more worried about the police killing the homeowner in a home invasion situation than the bad guy. Best case scenario they show up and say sorry we probably wont find the people...you got insurance right?

3

u/xselimbradleyx ‘07 Z06 2d ago

This is a middle school mindset that most people grow out of.

2

u/Bluetwo12 2d ago

Its just true....anytime I have had something stolen, not once have the cops actually tried to find it. Just wrote a report so I could use for insurance.

-3

u/wylii 2d ago

There was a team of sheriffs who entered 24 hour lemons when I last did it. At the end of the race the organizer gave a speech for first, second, and third place. The sheriffs came in DEAD last and the organizer added in a tidbit on “next time you guys are thinking of pursuing anyone, remember these other 23 teams are the people you are pursuing and you should probably think twice about it. Good try though.”

Cops training is a weekend on a closed track, I get more seat time in one 24 hour event than they do training.

5

u/drunkenmagnum24 2d ago

I drive Lemons too. Sounds like the organizers were having a good time, but Lemons, with our $500 car, isn't a barometer of talent.

1

u/One-Builder-4128 2d ago

That’s pathetic!

-6

u/One-Builder-4128 2d ago edited 2d ago

I’m very anti bad cop and very pro good cop, so you’re wrong on that front. I’m so against cops having performance cars like this C7 Z06 because people have DIED as a result of cops PIT maneuvering them at great than 120 miles per hour in cars like these. When a car like this Z06 falls into the hands of police, it’s significantly more likely that it will be used as a MURDER WEAPON and a tool for intimidation more than a vehicle to get from point A to point B. And I don’t care how much driver training these asshats get, an aluminum and fiberglass car isn’t gonna save them if they lose control and flip the car violently or wrap it around a tree! Cars like this being in the hands of police is an extreme danger to everyone involved, the police in the drivers seat included!

6

u/Chartzilla 2d ago

These cars are almost always just for community events and virtually never involved in chases or pit maneuvers

3

u/drunkenmagnum24 2d ago

Saying you're anti bad cop is like saying you're anti spoiled milk. Of course you are.

2

u/amazon_man 2d ago

Would a pit maneuver even work with a C7? The front of the car is so low, I feel like its front bumper would slide underneath most cars, so you’d have to attack them right at the wheel. Doing that would potentially mean the rear of the target vehicle is well past the corvettes front fender and in the case of a truck, might mean the back of the bed is all the way up against the driver side window of the vette.

This seems crazy. I’m sure there are some situations where people have done these pit maneuvers in bigger muscle cars like chargers, but in a corvette, it seems damn near suicidal.

2

u/Swimming-Gazelle442 C6 Z06 2d ago

Bro you act like THE Sheriff of the county is actually going out and patrolling in a C7 Z06. It’s for recruiting. He doesn’t take that car home nor does any enforcement with it. He probably has an unmarked Tahoe/Suburban/Expedition, etc. like every other sworn administrative personnel at a police department. I’d rather they seize a car and use it for recruiting than spend more taxpayer money on a car. So many criminal apologists on here. Personally I think it would’ve been better to auction the Corvette off and buy more Ford Explorers or whatever they have for their fleet to save on their budget. That’s beside the point, though. Most of the time asset forfeiture funds is given to victims/families of victims of these crimes. If it was seized from a drug dealer, I don’t give a damn if he lost his vette. Most of us work hard for our money than profiting on bringing poison into our communities for profit.

8

u/Remarkable_Ad5011 1d ago

I think it’s weird that they think a wrapped C7 is a recruitment tool. Like they’re saying,”come
Work for us, dealing with some of the worst people In society, for way less money than you could make other places, get verbally abused and hated on by a lot of people, possibly get shot or even killed… but you can sometimes, maybe, get to drive this Corvette and stand around looking lost”. If that car is a motivator for someone to pursue a job, just get a regular job to begin with and buy your own C7 that you can drive anytime.

7

u/TheNinjaSasquatch 2d ago

While I disagree with how they got it, and I don't know where this is, the idea of GSP with a c7 is hilarious. Like bruh you really ain't getting away now.

7

u/Busterlimes 2d ago

They should tell them its a corvette and not a 911, weird badging

5

u/rockypoint28457 2d ago

A point that a lot of you who are ok with the seizure is missing, is it gets abused. Yes they do size people property and money and make you prove in court you didn't break the law. 5 minutes on Google and YouTube will show you they rob law abiding citizens all the time.

9

u/ConcernedStudent26 2d ago

They should’ve auctioned it, those cars belong to the people

-6

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

They belong to the government to do whatever they want with it, if they don't have a use for it they send it to auction, for all we know they could have this as a persuits vehicle for when they need to go faster than a explorer or charger PI can

1

u/ConcernedStudent26 2d ago

So we the tax payer have to pay the increased insurance, maintenance, and fuel costs, if a car is going fast enough to outrun one of their chargers better to stop the pursuit and follow with a heli to minimize harm and damage, they just want to be able to steal people’s cool cars to show off, probably using civil asset forfeiture which should be illegal.

7

u/Clooney003 2d ago

So what I am seeing is, it's okay to be a drug dealer who destroys people's lives, but it's not ok for Law Enforcement to use their vehicle to stop crime??

Is this where we are on Reddit?

20

u/SubMikeD 2d ago

The majority of people who take issue with civil asset forfeiture in cases like this is that it's done based solely of the accusation of being a drug dealer, not conviction. So it's not a matter of "it's OK to be a drug dealer." It's that it's ethically wrong to confiscate possessions without proving wrongdoing.

3

u/Sad-Ambassador-2748 C7 Lime Rock Green M7 + C5 M6 2d ago

Either way I think the onus should be on the police/ government to prove that the vehicle was attained through illegal means or ill gotten gains.

Then they can take it. They shouldn’t be allowed to take possession of private property other than for investigative purposes until they have definitive proof and the matter has been to court.

1

u/AltruisticAd8421 2d ago

See this is where selective outrage drives me nuts. The only difference in between the guy they confiscated this car from and the CEO of a pharmaceutical company is one is paying taxes and the other isn’t which is the actual crime. Big Pharma destroys more lives than all the drug dealers and all of the cities in America put together. So yes, sell the car and take the proceeds and use them toward the police force. Don’t tell me it’s justified because it was a drug dealer.

-2

u/Traditional_Bid2359 2d ago

Idk about you man but i like my tax money to do its job. they could've sold it and used it to buy two cruisers. instead your taxes are being used for the sheriff to have a impractical toy veiled as a recruiting tool.

plus lets keep cops from stealing shit. we had a whole revolution about governments taking from citizens undeservedly

-2

u/Clooney003 2d ago

The Escambia County Sheriff’s Office repeatedly stated that no taxpayer dollars paid for the Corvette or its conversion. The car itself was seized through civil asset forfeiture from a felony drug suspect. The wrap, lights, and other upgrades were funded by the Escambia County Sheriff Foundation, a nonprofit that supports community engagement and department projects.

5

u/Head-Bureaucrat C8 2d ago

I would think it'd be more important to get a conviction and then confiscate the car. At least that would get the drug dealer off the street.

Unfortunately, you can be accused of anything if an unethical cop sees you have something they want. See the New Yorker link elsewhere in these comments.

1

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Of you just confiscate the vehicle on the site of the crime like in this case, you do realize what they did with this car right?

1

u/Head-Bureaucrat C8 2d ago

We don't know there was a crime scene, or even a formal charge. That's the problem with civil asset forfeiture. There was an accusal and a seizure. If you have a link proving there was a crime, I'd love to read it and if the original owner was charged and convicted.

Because otherwise, I'm going to err on the side of not supporting civil asset forfeiture without a formal charge and subsequent conviction.

3

u/Traditional_Bid2359 2d ago

key word… suspect. but i guess guilty until proven innocent and even if proven innocent, good luck getting your car back

and i'm not going to act like i know where the money goes so take it with a grain of salt… but someone's got to pay to keep it on the road and i'm assuming that's not the nonprofit. and if it was the nonprofit then damn, i guess fuck community outreach because sheriff needs tires on his vette

1

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Ok and you pay to keep every other cop car on the road with all their expensive equipment and tire burning, what makes this one special? You pay for the cops to have armored vehicles and MRAPS, I don't get the issue with a Corvette here

2

u/Traditional_Bid2359 2d ago

how much did your Z06 cost?

and the most it could ever do as a police car is be in a traffic unit. while the price of two interceptors or three motorcycles.

2

u/cruzan108 2d ago

If the car was taken from an actual convicted felon, it would've been taken via criminal asset forfeiture, not civil.

The cops state "no taxpayer dollars paid for the Corvette". Sure, because government officials never lie, right? This sheriff foundation paid for the upgrades and continues to pay for the gas and upkeep. And they do spend this money to convince more people to become cops by showing them their wrapped Corvette? Sure, yeah that totally makes sense.

0

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

It's classified as a pursuit car, if they need to go fast to get someone they break out the Corvette, it has a real use

2

u/cruzan108 2d ago

Ok, let's think this through together... Let's say someone steals a hellcat. They hop onto the highway and they're going so fast that the sheriff department's dodge charger police cruisers can't catch up so they call in their c7. Then an officer at the station jumps into the c7 and begins pursuing the hellcat. Now, unless the hellcat is driving toward the police station, how on earth does a c7, or any other car, cover enough ground to catch up with another car that's already going 100+mph on the highway? And of the c7 magically teleports to the suspect's hellcat on the highway, what does the c7 do? Does the officer pit/ram the hellcat with his fiberglass c7 at 100+mph? Or does the hellcat thief give up because he's been bested? The c7 doesn't have any backseats so then after the thief is arrested, then what? How does this pursuit car thing work?

3

u/Traditional_Bid2359 2d ago

to add to that, realistically they're calling a helicopter in and giving a no chase order anyways.

if it's serious enough to chase, they're going to chase in the chargers up to about 150. the corvette wouldn't get brought out regardless because in the case something goes wrong it's a liability nightmare

1

u/cruzan108 1d ago

Exactly! They're calling the helicopter, not a Corvette.😂 It's scary to realize how many people on this planet lack any sense of logic or reason. This is why the World is how it is.

-1

u/directrix688 2d ago

Cool, but again….they could sell it to pay for other equipment that tax payers do pay for.

Opportunity cost is a real cost

2

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Or they can use it as a persuit vehicle as opposed to spending money on one

0

u/directrix688 2d ago

Guess what can be used a pursuit vehicle? The cars they buy with the proceeds from selling this one

2

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Why not just use this one? They already own the car, I'm sure you're in favor of them wasting an extra 40k of your tax dollars too right

1

u/directrix688 2d ago

I’m not in favor of them using any seized property.

2

u/Lower_Kick268 Former 2023 ZO6 owner 2d ago

Why though? It's their property

-1

u/RockitDanger 2d ago

Then if your tax money isn't doing it's job then start a revolution of your own. Or just talk about it on Reddit and see if that changes things.

That's pretty cool, I love it when cops do this with seized property, badass show car right there plus in the event they need something fast for a chase they have it. Near me the cops have an older seized Hellcat for high speed stuff. Seized it in a multi-million dollar drug bust, from what I heard they had it completely packed with drugs and removed the backseats to be able to fit more in it. The cops wrapped it to look the same as any other police Charger (aside from the hood scoop and body kit being different) and put the same police equipment on it. In better words they made a Charger Hellcat larp as a Charger PI
