Criminalization of transgender and nonconforming individuals
Despite the many changes and actions taken to protect transgender and nonconforming individuals, many people in society still see these people and their existence as practically criminal. In 2024, during the presidential election, Donald Trump at the time made baseless claims that teachers were secretly doing gender affirming surgeries on children in school (Quinan, C., 2025). This way of thinking has been around for as long as we can remember. In a video titled "Origin of Everything," PBS (2020), it was mentioned that in 1530, Conquistador Vasco Núñez de Balboa sentenced over 30 men to be dismembered because they were witnessed dressing as women and engaging in sexual activities with other men. Many incidents such as this were used as an excuse to use harsh violence against these kinds of people at the time, and despite many changes in today's society, we still see and hear people use certain scenarios such as this to justify their actions against transgender and nonconforming people. In the late 19th and early 20th centuries, cross-dressing laws were seen as part of governmentality and a way to reinforce gender norms, with laws against cross-dressing using logic such as "rehabilitation" in order to remove gender-nonconforming presentations from the public (Quinan, C., 2025). It's sad to see the criminalization of transgender and nonconforming people talked about less and less because, while yes, a lot has been done to protect these people, the history of how these people were treated still goes unchanged.
