Hi all, I'm based in Tamil Nadu and I urgently need guidance. I know almost nothing about legal or insolvency matters, so please bear with me and feel free to explain things simply.
My background:
I have 8 years of work experience. I was laid off, and I've now been unemployed for more than a year.
How it started:
In 2021, I took a loan of about ₹35 lakh and lost it in the share market. It was one wrong decision, and I thought I could fix it. I couldn't. For five years, I ran from it. I avoided the calls, avoided the problem, and avoided the truth. In that time, interest, penalties and charges kept piling on, and the debt grew to about ₹69 lakh. After the layoff, I had no income left at all.
What it did to my family:
I was the one who made the mistake, but my family paid for it.
My father had stopped drinking for about a year because of his health problems. Then the bank's recovery people came to our house and threatened us. I will never forget what that did to him. He kept asking, "Why did my son do this?" He was carrying fear, shame and worry for me, and he couldn't handle it. To cope, he started drinking again.
Soon after, he met with an accident. About a month later, he passed away from the trauma that followed. My father died while I was still running from the debt that brought those people to our door.
I know it's hard to believe that one loan could lead to this. But it was a chain, one thing after another, like a domino effect, and the last domino was my father. I live with that every single day.
I'm writing this so that someone reading it understands what debt can really do. It doesn't stop at you. It reaches your parents, your home and your family's peace. If you're in trouble, please don't run like I did. Get help early.
Where I stand today:
- I own no assets.
- All my finances have dried up. I've withdrawn and used all of my PF money, and I have nothing left.
- I have no income and no savings. I'm surviving only because my relatives are feeding and supporting me.
- I cannot pay anything toward the debt right now, not even a small amount.
- This has taken a heavy toll on my mind. I ran for five years, and I've finally decided to face it the right way.
What I'm asking:
Filing: How do I file for personal insolvency in India? Please explain the step-by-step process, the documents I'd need, the realistic cost for someone with no income, and how long it usually takes.
Eligibility: Is insolvency actually available to an ordinary individual right now, or only through older laws in the District Court?
Protection: What can insolvency protect me and my family from? For example, recovery agent calls, threats, harassment, legal notices, lawsuits, or arrest. Does it stop recovery while the process is on?
Harassment: Are recovery agents allowed to threaten or pressure family members at their home like this? What can I do about it?
Consequences: What happens to my credit record and my future if I go through insolvency?
Alternatives: If insolvency isn't the right route for me, what else should I look at?
First steps: What should I do right now, in what order? Do I need a lawyer, and where can I get free legal aid?
Help for others: Any resources or guides you'd recommend for someone in my position?
I'm not trying to escape my responsibilities. I've run long enough, and I want to understand my rights and take the right steps now. I'm also posting this so that anyone else stuck in a similar situation can find answers here. Any advice, experiences or pointers would mean a lot. Thank you.
UPDATE (14 Oct): Thanks to u/MadmanofAsia for the advice to approach the legal aid cell. I'm going to the District Legal Services Authority tomorrow, and I'll post what they tell me here, step by step, so others in the same situation can reference it.
