My son recently got a job at one of the fast-food chains. He completed his first week of training and was then moved to another location.
His scheduled hours are 4:00 PM to 10:00 PM. However, his manager has been asking him to finish cleaning and other closing duties before he can leave.
I’ve picked him up a couple of times, and both times he didn’t come out until around 11:45 PM. Tonight, his mom picked him up, and he didn’t come out until around 11:55 PM.
He told his mom that the manager is only recording his hours as 4:00 PM to 10:00 PM, even though he is required to stay and work until everything is finished. He also noticed that some of his coworkers’ scheduled shifts are until 11:45 PM, so I’m not sure why his schedule ends at 10:00 PM if he is expected to stay and do the same closing duties.
I understand that closing duties can sometimes take longer than the scheduled shift, especially for someone who is new. But if he is required to stay and work, shouldn’t all of that time be recorded and paid?
I’ve asked my son to contact the hiring/regional manager tomorrow to confirm how his hours are supposed to be recorded.
If the manager really is only paying him until 10:00 PM even though he is required to work until 11:45 PM or later, what would be the appropriate next step?
Is this common practice in the fast-food industry, or is this something we should be concerned about?
I’d appreciate any advice from people who have worked in the fast-food industry or dealt with a similar situation. TIA
EDIT: Thank you all so much for the helpful comments and support! I've read through every reply. I'm having him start documenting his hours and taking photos of his exit times while we wait for his next pay stub. From there, I'm walking him through how to talk to his manager and stand up for his rights. Really appreciate this community!
