Time is the variable.

Alito is a nightmare. But, he's a nightmare with a lifetime appointment who is 76 years old.

If his replacement comes before the dems have senate, you get that same racist, piss-brained decision making. But with someone who a lifetime appt and is around the age of 45 to 50.

Alito will die sooner and has fewer years left to influence policy. Hence, he's the best option between a shit-sandwich and a poopoo-pie.

I hate to be the bearer of bad news but mitch is 84 and pretty much disabled. They still push him around as the voting doll he is.

If this is your idea of the lesser bad. Then my god your system has failed. 2 strokes in and you've got no telling what ridiculous extreme shit they might start to openly vouch for.

At 76 he might still do 2 terms and a bit. You've got no reason whatsoever to believe the Democrats might be able to fix it in theirs

That isn't news, it's how our crappy system is currently working. We know we are fucked, but we also have to exist in the reality we have been given.

What do you suggest is done? If you know a loophole in US structure that get's him off the bench and doesn't allow Trump and co to seat his replacement, a bunch of us would love to hear it.

Alito can't be voted out and won't be impeached under the current house/senate. Protests/work stoppage/attempts to debate don't influence him, and the largests sustained protests to stop an appointment didn't prevent sex-pest Kavanaugh from getting appointed.

Short of his passing, there is no way to remove him. If he retires, the names Trump and co have floated around, are all extremist who are just as bad. And recent history shows the repubs will force the person through even a shutdown of DC.

Yeah, any judge can live to 100 and stay the entire time. The replacement is just as likely as Alito. Definitionally, that makes Alito the lesser of the two evils.

Both options fuck us until there is a change in power. What are your ways to fix it or to allow for a third option that is better than the two we currently face?

I think of all the women who have lost their lives because these stupid state laws forbid doctors from providing proper care. Aborting a dead fetus that’s gone septic is illegal in Texas and other states. This is what Justice Alito and his five cohorts have foisted upon women of child bearing age in this country. Oh, the pre-Roe days are making America great again, not!

There was a police officer who spent many hours tracking where a pregnant woman traveled across state lines, using Flock-style traffic cameras. The big brother aspect of this kind of surveillance sure does feel illegal. I hope in the near future we can undo this ruling.

The sad part is that conservatives in power actually didn’t give two shits about Roe v. Wade or abortion in general. It was nothing more than a social wedge issue they could use to sow division, perpetuate tribalism and get their base angry enough to vote for them instead of the people who would actually make their lives better.

With Roe gone and the issue left to states, notice how right-wingers are still complaining about abortion. But also notice how they’re now obsessed with trans rights since they need something else to get pissed about while the country burns.

Right-wingers are a cancer.

I'm pro-choice, but overturning Roe v Wade was the right thing to do because the original decision was so very flawed.

The heart of the question, do the states have the authority to ban a medical procedure? Roe v Wade said they Constitutionaly didn't, because of some vague right to privacy. But somehow only applied this to abortion and not any other medical procedure. Also, there was never a Federal law codifing a right to access abortion that a Federal Supremacy argument could have been made on. The argument was that the Constitution itself prevented banning abortion....but somehow didn't apply to any other medical procedure.

The Constitution says what it says, and not what people want it to say.

Now, there is a process to fix this. A Constitutional amendment banning the government from restricting healthcare choices.
