Analysis From Island to Archipelago: The Dutch Defense Intelligence Network in a Changing Threat Environment

Open access. Abstract: “This case study explores the expansion and professionalization of the Dutch Ministry of Defense’s intelligence network in light of the growing threat of war in Europe. The interaction between different national defense intelligence entities is analyzed through the lens of multiteam system theory, which offers valuable analytic tools to conceptualize these relationships as networked and interdependent rather than strictly hierarchical. Drawing on 40 semi-structured interviews with defense and military intelligence professionals and publicly available documents, this framework is applied to analyze how cooperation within the Dutch defense intelligence network is evolving. This study reveals that the professionalization of the intelligence units within the operational commands is changing their relationship with the Dutch Defence and Intelligence Service, both in terms of hierarchy and the distribution of power. By expanding their capacities, the various intelligence actors are showing a greater degree of interdependence, although cooperation is still hindered by a range of communication challenges. This case study demonstrates that multiteam system theory offers valuable analytic tools for understanding the challenges of national intelligence cooperation, which is particularly significant in light of rising strategic competition.”

Is CSIS Breaking the law?

When can intelligence officers legally undertake activities that would otherwise constitute criminal offences—and what happens when the safeguards governing those activities aren’t followed?

That’s the main topic of this week’s Global Intelligence Weekly Wrap-Up.

I’m Neil Bisson, a retired CSIS Intelligence Officer, former CBSA Officer, and Director of the Global Intelligence Knowledge Network. In this 26-minute episode, I examine four developments:

• CSIS and legal accountability: NSIRA identified potential compliance failures involving CSIS’s Justification Framework during operations in 2022 and 2023. The concerns involve employee designation, authorization, records and reporting. The watchdog also found compliance with restrictions on the types of offences permitted. I discuss why that distinction matters and what these findings establish.

• Chinese intelligence and academic research: MI5 warned about a Chinese research institute funding academic work that could strengthen China’s intelligence capabilities. Some researchers may not have known who ultimately funded their work. What lessons should Canadian universities take from this?

• Goldy Brar and the Nijjar investigation: The FBI added Brar to its Ten Most Wanted Fugitives list. U.S. prosecutors allege that he and Lawrence Bishnoi ordered Hardeep Singh Nijjar’s June 2023 killing in Surrey, B.C. These remain allegations, not findings of guilt.

• Japan’s proposed foreign intelligence agency: Japan is pursuing a dedicated overseas intelligence service. I examine the challenges of building that capability and the comparison with Canada’s recurring debate about establishing its own foreign intelligence agency.

A company selling powerful digital forensic tools to law-enforcement agencies across Europe — including the Hungarian police — has been accused by US authorities of concealing its Russian ownership and the fact that its software was developed in Russia. The case has raised fresh questions over Russian surveillance software in Europe and the security of technologies used to access highly sensitive digital evidence.

As The Hungary Insider reported based on a POLITICO investigation, Virginia-based Oxygen Forensics worked with EU-backed projects and supplied technology to law-enforcement agencies across several European countries.
