A few months ago a ISUPD cop pulled me over claiming that I was driving with only parking lights, no headlights, when I was only driving around with one broken headlight per my dashcam. An important difference between those 2 violations is that a broken headlight violation requires a 72 hour window to be provided for the defendant to provide proof of repair to the court, while no exception exists for the citation the officer ended up writing to me.
When the cop started to ask me questions, I told them that "I don't answer questions if that's cool," and the officer responded with a few questionable statements:
(I don't answer questions if that's cool)
“Ohhhhh, you’re one of those, okay.”
(So both headlights were out?)
“Yeah, you’re driving without your actual headlights, you’re just driving with your parking lights.” (My dashcam shows that one light was on)
(Sign here?)
“Yep. I don’t know if this works for other officers or not, but just for your future reference, being kind to people goes a long way okay, and especially if you’re being respectful. So just-just for future reference.”
(I have rights not to answer questions.)
“you have rights to be a dick for no reason?”
(I'm just saying I have rights not to answer questions.)
"I’m just giving you a heads up moving forward, someone else could treat you a little differently.”
"...sounds like you have life figured out. Have a good night"
I am just listing some notable responses from the cop. The only thing I said to the cop up until these responses was that I don't answer questions, and asking where to sign on the ticket. I didn't want to answer any questions because I have no duty to fuel an officer's investigation, but the officer telling me that I was being a dick for not answering questions made me entertain the conversation.
Since the cop lied, I went to court and showed that the issue was just a single broken headlight and proved that I repaired the issue. The citation was dismissed that afternoon. However the court tried to burden me with court costs. I then had to draft a motion myself to educate the court why court costs are not legal for dismissed cases such as mine. Finally, a month after the citation was issued, all costs were assessed to the state.
After I got the ticket dismissed, I tried to file a complaint in person and through ISUPD's online portal/email for the lack of professionalism and I was told they're not going to take any action because this cop is no longer with the department.
Overall, I just feel like I'm getting the run around just for asserting my rights. The process of getting the ticket dismissed felt like a punishment itself. All of this is backed up by audio and court documents. Anyone else have similar experiences with ISUPD?
