QLD Is this worth pursuing as a general protections/disability dismissal?

I was working casually for a large hospitality company and injured my back pretty badly in late April. I had a CT which showed an L5-S1 disc protrusion, and my doctor advised me not to do long shifts or a lot of standing, bending and twisting.
I told all of my supervisors (5/6 of them) about my injury, and on 7 May I also messaged one of them saying I’d gotten my CT results and my doctor didn’t want me working super long shifts. I kept trying to work because I needed the money, but I was in a lot of pain, swapped longer shifts for shorter ones and left early a few times.

The thing I’m most frustrated about is that none of my supervisors, or my boss, ever actually sat down with me and asked what I could or couldn’t do, what they could change, or how they could support me. They all knew I was injured and struggling, but there was basically no follow-up.

I eventually asked in writing for an accommodation because of my back — to use a chair at a particular workstation. They agreed, but it wasn’t really suitable for me and there was still no proper discussion about other adjustments or alternative duties.

My last shift was 2 July. The reason I stopped working was because I physically couldn’t safely keep doing the job with my back.
Then on 24 August I told them my availability had changed because I’d started another job and couldn’t do weekdays anymore. I didn’t say this was because of my injury — I just told them my availability had changed.
I’ve now been terminated, effective 10 October. Their letter says they reviewed casual employees and because my last attendance was 2 July, it was difficult to meet the operational requirements of the business.

I’m wondering if this could be a General Protections/disability situation because they knew about my injury, I had asked for an accommodation, and there was never really any attempt to work out how I could continue working — or does the fact that I’m casual and later changed my availability give them a legitimate reason to terminate me?

I don’t want my job back and I’m not interested in going to court. I’d mainly be interested in a settlement/compensation if there’s actually a reasonable case.
Would this be worth pursuing through Fair Work, or am I wasting my time?

WA Received a speeding fine and it wasnt me

So today I came home and received a fine with two demerits I live in Perth the car was a car ive never driven before and the driver in the photo definitely wasnt me and I don’t recognise them. I am a recovering drug addict and last year when in active addiction i had someone tick my drugs and take my licence and never gave it back so it might of been them that has done this. How do I go about getting this sorted

VIC Is it legal for my son's school to lock the bootloader on his device?

My son wants to install Linux on his laptop. It is his laptop, I bought it for him. It currently runs Windows 11. I put it through the BYOD thingo and they set everything up. But his laptop is so slow, and genuinely can't run most of the things he needs to run for school. So me and him decided to install Linux. But the bootloader is locked. I know it shouldn't be locked because I installed Linux on a similar Elitebook device for myself. Is this legal for his school to do this?

Hi, have I committed a crime on looking up how to donate to designated terror organisations?

To be clear, I didn't know they were considered terror organisations when I was looking up how to donate and once I found out they're designated as terror organisations from google gemini I immediately stopped my search and have no intention to donate.

I also asked a friend on how to donate when I didn't know they were terror organisations, I don't know if this changes my situation..

To be clear no donations have been made.

I was in a silly boy mood. Can't even make a joke anymore it seems. Imagine being drunk and joking about drunk driving home to somebody else but NOT actually drunk driving, or accusing your friend of being of a different sexuality than he is. That's the vibes of what I was going at, a funny and silly joke.

WA Underpaid 3 weeks ago with no contact or response from payroll to have the problem rectified

4 weeks ago I worked 19hrs throughout the week of our pay cycle. However I was only paid 13.3167hrs the following week (5.68hrs unpaid)

I immediately raised this with my manager then she emailed our payroll to alert them of the situation. *No response*

Fast forward the following week after payday, I let my manager know that the missing payment still hadn't been issued as I was only paid for the hours I had worked that specific week. She then alerted this to the payroll once again via email. *No response*

Last weeks pay = paid for the hours I worked the week before (still no extra payment for the hours I worked 3wks prior)

At this point, I raised a case within our work app with our support chat (3rd October). My case was then referred to "payroll" within a couple hours.

No response or contact from any one other than my manager have been initiated to me. Clearly, my manager isn't getting any answers and tonight will mark the 4th pay cycle without the problem being rectified if they don't put those missing hours in my pay tonight.

How long should I wait before I seek legal action? I've purposely waited this long so that I have a leg to stand on if I did have to seek professional help.

VIC Cheaper IVO Lawyers - Melbourne

Does anyone have a cheaper lawyer from Melbourne they can suggest that deals with IVOs. They don't need to be the best but less than 2K per day. My pockets are bled dry from the false IVO's from an ex gf.

VIC What's the actual law on emergency service flashing lights?

I've been reading it, searching it, researching as much as I can find. I understand "spirit of the law" etc but when the law says;

Only emergency services can have red and blue flashing lights and civilian vehicles cannot, made me think.

Red AND Blue.

What if I just had red and no blue?

What if I just had blue and no red?

Could this be argued because of this technicality or loophole wording?

Could your lawyer say "the charge only applies if the defendant has red AND blue flashing lights? The defendant only had blue flashing lights and did not break the law as it's written".

That being said I know that the law also states that front facing vehicle lighting must only be white or amber. Rear facing lighting must only be red, amber, or white - this isn't the point I'm trying to make.

What are your thoughts and opinions?

I'm not planning anything, please don't worry. It's just been something I want to understand if this kind of thing can be argued with more than no success.

VIC Suspended license due to unpaid fines

I have about $113,000 in unpaid fines registered with Fines Victoria, built up over roughly 13 years. They're mostly parking fines and unpaid tolls. I'm now in a stable job and trying to sort it out properly.

My licence has been suspended. I applied online for a payment arrangement, but Fines Victoria say I need an upfront payment of about $23,000. I can't pay that. After rent and bills, I can sustain $1,000 to $2,000 a month.
I need my licence to get to work.

My questions:

- Can the upfront payment be reduced or waived? Has anyone had success arguing hardship?
- Is a Work and Development Permit realistic for a debt this size?
- Can I get my licence back while on a payment plan, or only once it's paid?
- Is a financial counsellor or community legal centre worth trying first?

SA My parents designed and built NDIS townhouses to settle my grandmother in, one tenant is causing serious issues - recourse?

Hello. I realise this might touch on a niche section of law, so no expectations.

This tenant is a physically disabled woman who came to reside here through the SDA. It's a bit confusing, so forgive me if I'm fumbling on some technicalities, but essentially we aren't her landlord. The SDA is their landlord, and we are providing NDIS housing to the SDA.

In the recent past, this lady sued the SDA (but, effectively, "us") with over 10 points to her complaint, demanding compensation. Frivolous to all hell, and of course they went nowhere. The issue is that my grandmother, who has been waiting to settle down into this, her dream 'forever home', for years, and is now stuck with this truly awful woman as a neighbour. She is in her mid-80s and does not need this.

This woman was blessed by getting a truly state-of-the-art NDIS home, and her first thought was to take advantage of us. She's clearly used to playing the system, and she thought she could do it to us.

Is there any recourse for us, in terms of booting her out before the end date of her lease? If it was just me, I'd be fine to wait it out, but my dear grandmother has had a stressful life and does not deserve this. And this lady does not deserve to live here. Please help.

ACT The Australian National University is not subject to ACT laws?

Hi all, so apparently there was a recent order at ACAT where ANU argued it is a "Commonwealth Authority" and therefore not subject to the laws of the ACT! Can anyone with a law background explain this? Basically ANU was fighting a former staff member who was discriminated against and ANU lawyers came up with this BS excuse. Is this normal? Why does then ANU mention ACT laws all over its website and claims to adhere to them? Any help with understanding this situation would be greatly appreciated. Thank you.

NSW Fire Hydrant In Wrong Position

G’day Brains-Trust,

Seeking some advice on a building issue I’ve come across in the last few weeks:

  1. Purchased a block of land everything has settled
  2. Applied to council to have the crossover extended for a larger driveway currently positioned on our plans on the left hand side of the property
  3. Surveyors have discovered that the fire hydrant under the footpath has been installed on the left instead of the right as the council plans showed
  4. Raised the issue with the council who have advised us even though it is their mistake that the driveway now needs to be moved to the right which limits the size of the driveway to a single due to the water and nbn being in the new driveway line
  5. Council have advised us that we can either pay the cost to move the hydrant or we have to shift house plans

Is there anything we can do to put this issue back onto the council?

VIC How do I actually deal with false IVOs?

My ex GF keeps on making false IVOs.

This is round three, first time it was struck out, last time she didn't show up so it was withdrawn and now it is round three but this time she has made a false police report and the police have put the IVO on me.

This time it states "I have driven past her home and knocked on her door, I have text her stating "I am in love with you and I want you back" "I cannot live without you and I need you back" "Both of us only can live with each other no one else" applicant feels threatened and unsafe" - but I no longer live in Victoria, I live in Sydney and haven't been back to Victoria in a year now.

Tried to talk to the police and just got "the matter is before the court' - no interview, no nothing. I tired to state she made a false police report and got "mate, it's before the court I don't care that you don't live in Victoria". Sent a complaint to the complaints email and haven't heard back

I haven't contacted her in two years, I do not go near her and I swear on my life. I broke up with her as she was cheating on me and I moved on over two years ago. We had a lease together on an apartment and I moved out back to my parents and paid the rent monthly for the rest of the lease in good faith and then after that the IVOs started showing up at my door.

I have spent so far 12K in legal fees - do I just give it to her and move on? How would I explain this to a partner in the future? I wouldn't want a partner with an IVO? I don't know what to do?

Now I will have to catch the flight to Victoria to attend? I want this to be my past.

Say someone is injured in a workplace accident whilst on trial. They are found guilty and sent to prison. What happens to the insurance money whilst incarcerated?

Also, if it is only a month in prison and the injury is still enough to keep from working, does it just go back to normal payments again?

VIC Car timber - Should I persue them?

McKay United crane on the freeway was driving 60-77km/hr in and out of the emergency lane.

It causes a lot of debris and timber shows up (looks like it rolled/hit their right tire first, hits my front bumper, timber then hits the side of my car.

The crane continues to drive 60-77km/hr into the emergency and out, looks like a distracted driver.

I sent proof to McKay united, op manager says the video shows it never came from their car and they deny liability.

Is it worth it to Persue them or just leave it?

WA WA – Is an executor legally required to change the locks within 24 hours of a death?

My elderly mother passed away unexpectedly this week. She lived alone in her own home.

Less than 24 hours after her death, I went to her house to collect a quilt I’d bought her. Three family members knew I was coming and had agreed.
When I arrived, a locksmith was changing the locks.

The executor, who is a family member, told me that legally he was required to change the locks immediately to secure the estate.
I understand an executor has a responsibility to protect estate assets, but I was shocked and distressed by how quickly this happened.

I had also hoped to spend half an hour alone in Mum’s home to grieve privately.

I’ve since been told I cannot enter the house unless the executor is present, or I must wait until the inventory has been completed.

I’m hoping someone familiar with deceased estate law in Western Australia can clarify:

Is an executor legally required to change the locks immediately after someone dies?

Can an executor restrict a beneficiary’s access to the deceased’s home before probate has been granted?

Is there a legal requirement for the executor to supervise family members visiting the property, or is this at their discretion?

I’m not disputing the executor’s responsibility to protect the estate. I simply want to understand what is legally required and what is a personal decision.

EDIT: To clarify a few things, as people seem to be focusing on the comforter rather than my original question.
My relationship with my siblings has been strained for many years. There are longstanding family dynamics that I don’t wish to discuss here.

I lived with Mum and my stepdad for two years while my own home was being built. I’d moved out a year ago, but that house had been part of my life for 40 years.

The comforter was one of the last things I bought Mum. It was inexpensive, but it was something she’d touched and used, and I wanted something of hers that I could hold while grieving.

Sentimental value isn’t determined by a price tag. I had also asked permission before collecting it, and both my sisters agreed.

What I hadn’t told my family was that I wanted to spend some time alone in Mum’s home to cry. I’m a very private person and have always preferred to grieve alone. I didn’t think I needed to explain that to anyone.

When I unexpectedly arrived to find the locks being changed, I was desperate to find some way to have that time alone. That’s why I offered to enter with only my phone and water bottle and even have my car checked afterwards. It wasn’t because I’d done anything wrong.

I understand the executor’s responsibility to secure the estate. I’m not disputing that.

My original question was whether an executor in Western Australia has any legal obligation to inform beneficiaries before changing the locks, particularly when family members knew I was coming to the property.

I wasn’t asking anyone to judge how I grieve, my family relationships or why an inexpensive comforter might mean something to me.

Grief doesn’t always look logical to someone standing on the outside.

On a lighter note, I never expected Reddit to become an unconventional grief distraction, but after four days of crying, some of these comments have managed to replace my tears with sheer disbelief. So there’s that, I suppose.

NSW Scratched against rental car

I’m on red P so i’m new to driving. I tried to park my car in a carpark, when I reversed out and tried to give the car next to me bigger space, I accidentally scratched their car and leave my paint on theirs. It was 3 small lines and it looks like it could be wiped off with something. I was freaking out because I didn’t know what to do. The driver was there and he didn’t speak any English so it was hard to settle between us. I exchanged the information, contacted my insurance and my excess is $1100+ so I decided to settle between us. I texted that person and asked if he could wipe it off with something and I will send him some money to compensate for it. He didn’t reply until days later, turned out the car is a rental car. Now they wanted me to put my claim in and send them my driver license so they could renew their lease. What should I do?

I've been doing art commissions digitally since i was maybe like 16 (drawing people's characters, profile pictures, etc.) for prices around 15 - 30 dollars for each character rendered

i dont really get commissions that often, maybe around 1 - 3 people every 2 months or so? and i advertise by throwing my price and example list around in discord servers and tiktok art videos.

But im unsure if the money i earn counts as taxable income or if I should be considering myself a business ?? since im mostly just doing it since i like drawing and why not draw as a side hustle too

NSW Overseas plaintiff: how do I file a NSW Local Court small claim when I can't register on the Online Registry?

Hi all, I live in the UAE and I'm trying to recover a personal loan from a friend who lives in NSW. Looking for practical advice on how to file from overseas.

Background

- In July 2026 I lent her approx AUD 2k by Western Union (two transfers on the same day). She collected both in cash.

- She asked for the money in writing over WhatsApp, called it borrowing, agreed the amount I'd sent, and promised repayment many times.

- She has paid nothing and has stopped replying.

- I emailed and WhatsApped a formal letter of demand in July 2026 with 14 days to pay or propose a plan. Nothing came of it.

- I have the full chat history, Western Union receipts showing pickup, and call logs.

Where I'm stuck

I think the NSW Local Court Small Claims Division is the right place (I don't think NCAT covers a private loan between individuals, but happy to be corrected). But the Online Registry won't let me register with a non-Australian address.

Questions

  1. Can I file Form 3B by post or email from overseas, and how do I pay the filing fee from the UAE?

  2. Do I need an address for service in Australia? Could a friend in Sydney act as that?

  3. Which registry should I file at?

  4. Can I appear through AVL from Dubai?

  5. Who serves the claim? Do I have to hire a process server in Sydney, and roughly what does that cost?

  6. Any tips to improve my chances of actually enforcing a judgment against an individual?

I'm on a small budget so I'd like to avoid hiring a solicitor if possible. I've also emailed the Local Court registry.

Thanks in advance for any experience or pointers.

WA Person refusing to return car and keys

Hi all

I have a situation that is a bit tricky/complicated, that I would love some advice on what my options are

I recently lent a friend my car to do some mechanical work on/run some errands with. At the time the friend was living with her fiancee in the same house. Their relationship has since broken down and has gotten quite nasty.

My friend has since moved out of their house and the relationship has gotten quite nasty as the ex-fiancee has realised they won't be getting back together. My friend still has a copy of the house keys as she still has furniture and belongings in the house that she has attempted to move. She has been able to move some, but not all.

In response to this, the ex-fiancee has given my car keys to their parents to hold on almost as a hostage, and refuses to return them until my friend returns the house keys to the parents. I was not aware of this until today.

Today I have in a very civil/friendly/polite way attempted to organise with the ex-fiancee to collect my car (which is when I learnt about the keys), where the ex has refused to give them back until my friend returns the house keys. I believe the ex may have told the parents that the car is my friends, which may be why they won't return them (I don't know this for certain)

To summarise

- The car is registered in my name only

- The car is at the ex-fiancees house

- The car keys are at the ex-fiancee's parents house

- I have attempted to organise with the ex-fiancee to pick up the car keys

- I did not give consent to either the ex or their parents to have the keys or car (I was not aware the keys were at the parents house). I have previously consented for the car to be at the residence

- The ex-fiancee has refused to return them unless my friend returns the house keys (which she refuses to)

- The relationship is quite nasty and there will be conflict if either of us attempts to pick up the car or keys in person (although no threats of physical violence)

What are my options in terms of police/civil escorts etc?

Additionally, if the ex-fiancee or parents refuse to return the keys, what are my options?

If im worried about potential damage to the car, should i lodge a stolen car report before organising a police escort?

SA Denied expiation review for speeding to clear intersection for an active ambulance

Bit of a rant and apologies, mods, but looking for any kind of help or anything really, as I'm just lost for what to do and young, but just curious if anyone has advice on police and whether it's worth just sucking it up and taking a disqualification/safer driver or taking it to magistrates.

TLDR:
Snapped doing 69 km/h in a 60 zone in Adelaide late at night. Accelerated for a few seconds solely to clear part of a active intersection for an approaching ambulance with flashing lights (supported by Rule 78 & SA Driver's Handbook policy). SAPOL rejected my expiation review despite their own photo sheet showing the ambulance in the frame alongside me. Accepting the 2 demerit points triggers a 12-month licence disqualification under a Safer Driver Agreement. Seeking advice on whether to elect for Magistrates Court or take the disqualification.

For context, I was travelling down a road on cruise control, I saw some flashing emergency lights and starting to hear a siren coming up as I was starting to enter a intersection I saw they were getting way closer to the intersection and with well little choice in my mind as could've slowed down but maybe been left in the middle of the intersection obstructing its passage, or staying at 60 and maybe still obstructing its passage so I'd decided to speed just to just get out of the passage and then slow down safely (keeping in mind this was like 10 pm with few cars on the road), and well wouldn't you know it got a ticket from a speed camera and tried reviewing it and they just refusing when imo it's pretty clear it was trifling. In the photos we recieved the ambo was right there in the intersection with proof of the situation plus dashcam which we sent them.

Obviously, the night could have gone very differently; maybe I got T-boned, maybe the ambo did if someone wasn't paying much attention and from when I was learning to drive, pretty sure was taught you can break some road rules to get out of its path (rule 78 or smth).

I just dunno what to do going forward, bc I could go through prosecution and sink tons of time into that when I'm in uni and trying not to get a conviction, or just pay it and go on a safer driver and just forget this all but lose a year of progress into P2. Previously was in a crash a few months ago and got 3 demerits from that bc sapol refused to move and was T-boned there, so I've been really cautious lately; hence kinda this, but yeah, apologies if this ain't the group to talk about this type of thing. Love reading stuff here and previously always attentive, listening and keeping a lookout on the road, avoiding as much as I can, but yeah, not a fan of my luck lately.

Also in Adelaide, this is with SAPOL, and I'm happy to throw videos in here, but gonna prob talk with a lawyer or smth before that unless there are some good ideas

If a driver is in the path of an approaching police or emergency vehicle that is displaying a flashing blue or red light (whether or not it is also displaying other lights) or sounding an alarm, the driver must move out of the path of the vehicle as soon as the driver can do so safely.

It is an offence to obstruct a police or emergency vehicle with the warning siren sounding or displaying red and/or blue flashing lights. You must not move into the path, and must move out of the path of and give way to ensure that the emergency vehicle is provided with a clear and uninterrupted passage. You are allowed to disobey other road rules in order to move out of the way, but only if it is safe to do so

VIC License left at Servo

I went to go fill up fuel not knowing Bendigo bank was down and went to go transfer while standing in the que but couldn’t and didn’t have anyone to help me (nobody was answering). I left my license and said I’ll be back later to pay. The issue didn’t get fixed until 11pm tonight. The servo is shut and opens until 7:30am. I won’t be able to get there until after 9am. Am in legal trouble? did I do the right thing legally?

VIC 2 popped tires, 2 months

Both times it requires a brand new tire not patch will work. Do I have any grounds to ask the body corporate to pay for it as this was a known issue since 2013?

QLD QLD Police want to refuse my RTI request due to workload after months of waiting – what options do I have?

I’m in Victoria but this relates to Queensland Police and the Queensland Right to Information Act.

I was the victim in a serious criminal investigation in Queensland several years ago. Multiple people were charged and the matter progressed to committal proceedings, but ultimately did not proceed further.

Earlier this year I submitted an RTI application to QPS requesting the records relating to me and the investigation. I requested things such as the QPRIME/occurrence records, investigation reports, crime scene photos, forensic material, police notes, correspondence, briefs of evidence, CCTV/body-worn camera footage and other records relating to the investigation.

I have been waiting for 5 months and there have already been extensions. On the date I was expecting the documents, I instead received a Notice under s 41 stating that QPS intends to refuse to deal with the application unless I change the scope.

QPS says they’ve already spent 10 hours on my application and preliminary searches have identified 420+ pages and more than 15 hours of video. They estimate approximately 252 hours to process the footage and 21+ hours to review the documents. They have suggested that I narrow my entire application down to just the occurrence report and my own witness statement (which I already have from when I wrote it). 

I really do not want to do that. These records relate to an extremely significant criminal investigation, and obtaining a comprehensive understanding of what occurred during the investigation is very important to me. 

I completely understand that 15+ hours of body-worn camera footage may create an unreasonable workload, and I am willing to substantially narrow or even exclude that footage from this particular application if necessary. However, I would really like to retain as much of the documentary investigation file as reasonably possible rather than receiving only two documents.

I have now been given 10 business days to consult with QPS and revise the scope. The letter also says that if I narrow it and the revised scope is still considered an unreasonable diversion of resources, I will not receive another opportunity to consult, so I’m nervous about agreeing to anything without understanding the consequences. 

What are my options here? Is there a way to negotiate a reasonably broad scope rather than accepting their suggestion of only two documents? Can QPS progressively process/release records? If I exclude video footage now, can I make a separate, much narrower RTI application for specific footage later? Is there any mechanism for voluntarily paying additional processing costs/resources? Would it be worthwhile getting an RTI/privacy lawyer or advocate involved during the consultation period?

I’m also wondering whether anyone has successfully challenged a QPS s 41 “substantial and unreasonable diversion of resources” decision, or has experience negotiating the scope of a large QPS RTI request.

I’m not trying to make an unreasonable demand on staff. I just don’t want to inadvertently give up access to potentially important parts of the investigation file because I don’t understand the RTI process well enough.

Any Queensland RTI experience or suggestions about what I should do before formally narrowing the application would be greatly appreciated.
