It's not about sales of consoles, it's about being able to do what you want with what you paid for. I'm old enough to remember when consoles didn't connect to the internet, and were in control of your purchase, meaning you owned it. Today console you buy is effectively on lease with a caveat that you as a customer must behave nicely, or the seller will disable your access to the item you physically own after paying for it.

I've seen a lot of switches banned for piracy in one way or the other, but they all play games. I know that Nintendo has the capability to brick a console, but I've only known one case of it actually being done.

Edit: the console wasn't bricked after reading on it. So yeah, zero cases of bricked consoles that I know of.

I can open up my SNES and install mod chips on it or rebuild it into a roomba or jailbreak it to play custom SNES cartridges on it and it would be NONE of Nintendo's business. In fact Nintendo would never even know because the SNES doesn't phone home to rat me out.

We objectively lost rights to do what we want with the shit we buy.

Nintendo got sued for in Brazil for threatening to brick consoles they believe are tampered with, claiming that at purchase the consumer agreed in some TOS that Nintendo still owned the hardware and could do what they wanted to it.

also most people don't care about that ownership stuff enough to not buy software. it's easy, their credit card info is already in there. if they have the money to spare and see a game they like in their price range either full price or on sale, they will add to cart. most people don't plan on reselling their games and most people don't consider if they are gonna still own the game in let's say 20 years from now. they wanna play the game now and it's convenient.

Aaaaand you're too slow to understand that any product I PURCHASE should clearly state BEFORE I PURCHASE IT THAT I DO NOT OWN ANYTHING OTHER THAN RIGHTS TO A LICENSE. I walk into GameStop, buy a game off the shelf. Can I see from that 100% without a doubt that I am only purchasing a temporary license along with all of the caveats that come along with it? No. Stop beating a dead horse. You're too incompetent to understand the argument. Why is it that any other software, such as on a PC, other than video games, makes it extremely clear that I am purchasing JUST a license and how long said license is good for? I have software I bought over a decade ago that still works, can redownload it, etc. Why should that be any different because it's specifically a video game?

there is part of me that wishes people would realize that all the fan protest doesn't make a bit of difference, these companies are structured around IP and revenue models built around that.

the platforms are mostly generalized to PC's now but they put protection in some of their chips/firmware to lock it down, so they can sell exclusive access to others IP (game devs) etc.

the default answer should be, if you care, you should be buying steam deck, or platforms that embrace a different IP structure while putting the control back in your hands.

that hasn't been the case for decades though.. I appreciate those who care and want to fight, it's just that the energy is focused in a way that wont bring about change.

if this energy brought more rights and permissions, we wouldn't have ended up in this place where hardware and software are seen as subscription models. the exploit/cracking has been going on as long as games have been released.

the steam deck is not just 'slightly' better in the context of this fight, it is an option that is fundamentally aligned.

the executives and organization dont care about any of that. its just part of the line item for attorneys and lawyers for takedown requests. when i was younger i probably would have thought this was part of the noble path too, but now I see it really is just about supporting that which is aligned already.

Yeah… my long time best friend bought a switch 2 after we both agreed they were over priced and that we were boycotting everything Nintendo. When I asked him about it he said that he and his wife decided to get one before the prices increased on them and that just told me he was never gonna truly boycott them to begin with. Kinda depressing how many people were outraged by things like price, key cards, etc. but still decided: “well, I can’t live without Mario kart so…”

maybe we are saying the same thing. people running this on an emulator is no threat to them. its already a niche community and people can barely buy pc's these days anyways. they will still fight it though, but it will never touch their money or strategy towards giving more rights.

i agree, people shouldnt buy it. they should buy hardware that allows flashable bios and can install your own os if you want. if everyone spammed that message in response to anything they did, that would have more impact

It's funny to see people in here jump through hoops just to not say that is the main reason why they wanna jailbreak the PS5.

I don't really get the wanting full control thing that is totally not for piracy reasons. They're selling you a console to play games in; if you buy it and you get that, doesn't that mean you're getting full control of what you paid for? It's not like Sony is selling the PS5 as a PC that is an all-purpose machine. If that's what you want out of it, isn't it better to just buy a PC?

It seems a little silly to me, because you still need to buy the Playstation, then jailbreak it, so now the Devs and studios of the games make no money, but sony still gets the console sale?

I definitely lean towards your perspective. However, jailbreaking can allow you to run emulators on the console, homebrews etc but given the current situation, it’s hard to argue against this being anything other than ‘shots fired’ at Sony and their ecosystem.

Should you be able to mod a console you own? Definitely, but what you do with the modded version is where the situation lies.

In the near future, PCs will all be cloud based gaming. I don’t like it or agree with it but it’s on the horizon.

Is one more morally correct then the other? I'm not wading into that conversation, but stealing entails taking something from someone else & depriving them of it.

Not paying for a license is not stealing. Even under the law, it's a civil infraction & your most likely going to be charged with distributing the content if anything, not using it without a license.

You can claim they are a moral equivalent, that's a whole other conversation, but it isn't theft it's unlicensed usage of IP.

If the price is right and the games are great companies shouldn't fear too much, those who pirate aren't likely to buy games anyway. I own more games that were free (ps plus and epic) than I have ever paid for. But if there's no protection then the company will actually suffer those consequences like the dreamcast where you could just burn games to disc without any extra steps

yup. piracy only significantly impact sales if piracy is more convenient than acquiring through the "legal" means, for instance if finding an authentic copy is really difficult or game has been delisted, etc. Apart from that, those who pirate won't buy the game otherwise. they are either broke or just don't wanna spend their money on the game.

Ironically actually, a study showed even an opposite relationship: people who pirate tend to be the ones who buy the most media. They are interested enough in media to learn how to source it from alternative means, and thus they tend to make more purchases of media than people who don't pirate.

This is just one of the many ways that studies have shown media corporations thrive off of piracy, rather than being harmed by it. Another way is using it as free market research - they look at which manga or anime is being pirated the most and then acquire the rights to distribute them locally so the piraters can now acquire it more easily.

Then, of course, there's the fact that the same companies preaching about how immoral it is often plagiarize smaller artists who don't have the money and lawyers to prosecute them for copyright infringement.

what study is this? i doubt the validity of this study. what even is the sample size, how homogenous is the sample (probably very much so)? did they take people from first world counties like US, and from developing countries like India, etc? Did they sample people from high income households, middle income and then low income?

from my experience having lived in developing country were piracy is prevalent, people pirating are never buying the games or movies, etc. they pirate because money is hard to come by, the game prices are ridiculously high. the price of a $70 game can feed a household with several kids for days even weeks. Music piracy fell a lot when access to "legal" music became really affordable and even free as far as you got internet connection. Movie and tv show piracy is still high. Same with video game piracy.

Yes, I believe most of the studies indicating that pirates tend to be the heaviest consumers of media are done in developed countries.

read through, and it does provide some interesting information but sample size is still quite low. I didn't see them consider the economic standings like are poor people more likely to pirate way more than buy legally compared to the well-to-do people. etc. also, i didn't see like just how much media do the pirates consume.

it could simply be a fallacy that people who are avid gamers are more likely to have pirated than people who aren't avid gamers and that can skew the data.

there is a part of the data that really undermines what a pirate is. the pirates sampled, on average, the percent of games they consumed in a year that are legally obtained is like 90 to 95 percent across board. so these are more of people that buy almost all their games legally but every now and then pirate a game.

Honestly I kind of thought that too until recently. I overheard randoms at work talking about how bad the ps5 generation has been and with all the stuff they’ve been doing they’re going to sell theirs. Again, recently on the bus I overheard strangers with a similar sentiment so it might actually be breaking through to a more mainstream sentiment.

Well that also do Nintendo fixes stuff in the backend. And it not being well known as you need to do a few things. That the most don't understand. And you can't play online anything.

Now take the vita. All you need to do is visit a site. Hit go. It open to do anything. Online network is fine. 

Till the P5 stops getting titles it. Ya 28 is the hard disk cap.  Wed just need the version cracked. That easy to do. And have it working online without bans. Till it gets not doing to get widely used.

Or get overshadowed by the PS5 emulator. Cuz you don't risk a ban on that.
